The Claims Process
How Bonnar Accident Law Solicitors will manage your claim
Bonnar Accident Law is committed to winning your claim and achieving the maximum amount of compensation available under the law.
Remember, you pay us nothing, ever, if we don’t win your case.
You will readily appreciate that in the current economic climate the defender’s insurance company will seek to dispute liability and reduce the value of your claim. This is why you need to be able to prove that you have suffered an injury and that the accident was caused wholly or partly by someone else.
Our job is to help you prove what happened to you, prepare your case and pursue your claim to a successful outcome.
Your role is to help us understand the circumstances of your accident or illness and provide us with as much evidence as you can.
In order to properly quantify the true value of your claim you may be asked to visit a specialist doctor, at our expense, who will assess the extent of your injuries or illness.
5 simple steps to a successful claim
Step 1 – Initial discussion and free expert legal review of your claim
When you call us we will discuss your claim with you free of charge there and then over the telephone, or arrange a face to face meeting if you prefer.
In order for us to assess your claim and give you the best legal advice, it is important that we understand the nature of your injury, the events leading up to your accident, the impact your injury or illness has had on you and your family and what the future holds in terms of your employment prospects and physical capabilities.
Step 2 – Preparing your personal injury claim
From the moment you appoint us to represent you and pursue your personal injury claim we will prepare the best possible case for compensation and present this directly to the defender’s insurance company with the aim of achieving a settlement without having to resort to court proceedings.
The preparation of your case will typically involve taking photographs and measurements of the location of your accident or injury (including any equipment, machinery or vehicles involved), witness statements and expert medical or other professional opinions and reports.
Please remember that under our ‘No win – No fee’ policy you pay nothing at all towards the costs of preparing your claim, regardless of the complexity of your case.
Step 3 – Pursuing your personal injury claim
Bonnar Accident Law has nearly 40 years’ experience in pursuing compensation claims in Scotland and achieving the maximum possible level of compensation for our clients. We know the law and we know how to deal with insurance companies and their legal advisors.
You and your family can be assured that the acknowledged personal injury compensation experts are on your side and we will pursue your claim with professionalism and vigour.
If the insurance company rejects your claim or makes an unreasonably low offer in the hope that you will accept it, we will raise court proceedings on your behalf. Your appointed solicitor, who remains in overall charge of your case throughout, will keep you fully informed of all important developments.
However, the vast majority of claims actually settle ‘out of court’ and an acceptable settlement is usually reached before the hearing date.
Step 4 – Court proceedings
You have absolutely nothing to worry about should your case go to court
We understand that attending court can seem a bit daunting, so we take great care to ensure that you fully understand the procedures involved so that you can feel relaxed and calm on the day.
Remember that Bonnar Accident Law is at your side with advice and support every step of the way.
Step 5 – Your cheque
If your claim is successful you will be awarded financial compensation.
Under the terms of our ‘No win – No fee’ agreement, we will apportion an agreed percentage of the lump sum we win for you to cover our outlays, interest and fees and mail you your cheque.
