    Claiming compensation for a road traffic accident in Scotland

    Injuries resulting from a road traffic accident can range from relatively mild (whiplash) to very serious and life-threatening multiple fractures, head and spinal injuries and severe burns.

    Car and other vehicle drivers

    Drivers

    If you were involved in an accident that wasn’t your fault when you were driving a vehicle, you may be entitled to claim compensation against the other party’s insurance company. You should take the following initial steps after any type of vehicle collision involving an injury:

    • Seek medical attention asap and report to your GP following a hospital admission
    • Exchange insurance details
    • Take photographs (if safe and appropriate to do so)
    • Obtain any witness names / contact details
    • Inform the police

    Pedestrians

    If you have been knocked down by a vehicle you will have a very good chance of making a claim against the driver – whatever the circumstances.

    The elderly and the young are at particular risk on today’s busy roads and all it takes is  a moment’s lack of attention on the part of  a driver to ruin a family’s life forever.

    It is not uncommon for pedestrians to be injured when using a pedestrian crossing. Cars and other road vehicles can swerve out of control and mount a pavement.

    Car passengers

    Whiplash injuries are very painful and can cause long term damage to muscles and nerve fibres. You should be examined by a medical practitioner asap and then call us for independent legal advice on the merits of your claim.

    A passenger in a car, van or other vehicle which caused an accident is also entitled to claim against the driver. You may be worried about making a claim against a family member or a friend but please remember that all claims against a vehicle driver are dealt with by the driver’s insurance company.     Bus and coach passengers

    Buses and coaches carry such a large number of passengers that there is potential for numerous injuries in the unfortunate event of a collision, emergency stop or other accident.

    Bus injuries may occur when passengers are thrown around in the bus and common injuries include cuts, bruises, whiplash, fractures and head injuries.

    Coach accidents typically involve teachers and schoolchildren on trips and holidaymakers on sightseeing tours.

    Taxi passengers

    Many people now use seatbelts when travelling as a passenger in a taxi, but serious injuries can still result from the taxi being in a collision or if the driver is forced to make an emergency stop.

    You may claim compensation if you have sustained a personal injury as a passenger in a taxi, if your injuries resulted from the actions of the taxi driver or if another road user was at fault.

    ‘Hit and run’ victims

    If you were the victim of a ‘hit and run’ driver or if the vehicle was stolen or driven by an uninsured driver you may still be able to make a claim.

    Many uninsured drivers flee the scene of an accident in an effort to escape the repercussions as some cars at fault in a ‘hit and run’ accident are often stolen. This does not affect your legal right to make a claim.
